Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern use of the District Behavioral Health Marketing Analytics Platform and Social Posting tools (the “Platform”) operated by District Behavioral Health and its operating brands (“we,” “us,” or “our”).
By signing in or using the Platform, you agree to these Terms and to our Privacy Policy at https://districtbehavioralhealth.com/privacy-policy/. If you do not agree, do not use the Platform.

2. Who may use the Platform

The Platform is for authorized District Behavioral Health staff and approved contractors only. It is an internal business tool. It is not a patient portal, is not intended for patients or the public, and is not used to deliver treatment or health care services.
You may use the Platform only if we have granted you an account and you are acting on our behalf. You may not share your login or allow anyone else to use your account.

3. What the Platform does

The Platform is used to review marketing performance and to create, schedule, and publish organic social content for advertising and social accounts that we own or control, including brands such as District Behavioral Health, Gratitude Lodge, Renaissance Recovery, Alliance Recovery, California Detox, and Connections Mental Health.
Depending on your role, the Platform may let you:
View advertising and analytics reports
Connect or disconnect marketing and social accounts
Draft, schedule, and publish posts to Facebook, Instagram, LinkedIn, TikTok, and other channels we enable
Use AI-assisted drafting tools when those features are turned on

4. Accounts and access

Access is controlled through Clerk authentication and our internal role settings. Administrators may connect channels, authorize third-party apps, and run account syncs. Non-administrators may use publishing and reporting features we assign to them, but may not authorize new channels or change system connections.
You are responsible for activity under your account. Notify admin@districtbehavioralhealth.com immediately if you believe your access has been misused.
We may suspend or revoke access at any time, including when you leave the organization or no longer need the Platform for your role.

5. Connected third-party services

The Platform connects to third-party services so we can operate our own marketing. Those connections may include:
Google Ads and Google Analytics 4
Meta (Facebook and Instagram)
LinkedIn
TikTok, including TikTok Login and the Content Posting API
Clerk, Supabase, and (when enabled) OpenAI
When you authorize a connection, you allow the Platform to act on the connected account as permitted by that service and by your role — for example, reading performance data or publishing a post you have reviewed.
Each third-party service has its own terms and policies. You must follow them when you use that service through the Platform. We do not control TikTok, Meta, LinkedIn, Google, or other providers, and we are not responsible for outages, content review, account restrictions, or changes they make to their APIs.

6. Content you create and publish

You are responsible for the captions, images, videos, and other materials you submit or publish through the Platform. Before you publish, you must confirm that:
The content is accurate and not misleading
You have the rights to use the media, music, and any likenesses included
The content complies with our brand and clinical guidelines, applicable law, and the destination platform’s rules (including TikTok, Meta, and LinkedIn community or advertising standards)
Statistics and claims are sourced and are not invented
The post does not include protected health information or anything that could identify a patient
Publishing to a live social account is final once the destination accepts the post. Scheduling a post does not guarantee it will go out if a connection expires, a platform rejects the content, or the Platform is unavailable at the scheduled time.

7. Acceptable use

You may not use the Platform to:

• Access accounts or data you are not authorized to use
• Publish content that is unlawful, deceptive, or that violates a platform’s terms
• Scrape, resell, or misuse data from connected advertising or social accounts
• Attempt to bypass access controls, rate limits, or security features
• Use connected APIs for any purpose other than our own marketing operations

8. Health information

The Platform must not be used to collect, store, or publish protected health information (PHI) or to provide treatment. Do not upload patient names, records, photos, or other identifying clinical information. Our HIPAA Notice of Privacy Practices continues to govern patient health information and is separate from these Terms.

9. Intellectual property

We own the Platform, including its software, design, and documentation. Our brands, names, and logos remain our property. Content you create in the course of your work for us is owned by District Behavioral Health, except for third-party materials (for example, licensed stock imagery or platform-owned features) that remain subject to their original licenses.

10. Disclaimer

The Platform is provided “as is” for internal business use. We do not warrant that it will be uninterrupted, error-free, or available at any particular time. Reports depend on data from third-party APIs and may be incomplete or delayed. AI-assisted copy is a draft only; you must review it before publishing.

11. Limitation of liability

To the fullest extent permitted by law, District Behavioral Health and its brands are not liable for indirect, incidental, special, or consequential damages arising from use of the Platform, including failed or delayed posts, third-party account actions, or reliance on reports. Our total liability arising from the Platform is limited to the amount, if any, you paid us specifically for access to the Platform in the twelve months before the claim. Internal staff are not charged a fee for access.

12. Changes

We may update these Terms from time to time. The effective date at the top will change when we do. Continued use of the Platform after an update means you accept the revised Terms. Material changes will be posted on this page.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. If a court finds any part unenforceable, the rest remains in effect.
